WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT CONTENT IS ACCURATE, COMPLETE, OR CURRENT. WE MAKE NO WARRANTIES ABOUT THIRD-PARTY PRODUCTS OR SERVICES MENTIONED ON THE SITE.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, NITROUSWEB AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, ANY CONTENT, OR ANY THIRD-PARTY PRODUCT OR SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100).

Some jurisdictions do not allow certain disclaimers or limitations, so some of the above may not apply to you.

Indemnification

You agree to defend, indemnify, and hold harmless NitrousWeb and its owners, employees, and agents from any claims, damages, losses, liabilities, and expenses, including reasonable attorneys’ fees, arising out of your misuse of the Site or your violation of these Terms or of any law or the rights of a third party.

Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to its conflict of law rules. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to the personal jurisdiction of those courts. Before filing a claim, you agree to contact us and attempt to resolve the dispute informally for at least 30 days.

Changes to the Site and these Terms

We may change, suspend, or discontinue any part of the Site at any time. We may also update these Terms. The updated version will be effective when posted, and the “last updated” date will change. Your continued use of the Site after changes are posted means you accept the revised Terms.

General

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce any provision is not a waiver of our right to do so later. These Terms, together with our privacy policy and other policies referenced here, are the entire agreement between you and NitrousWeb regarding the Site. You may not assign these Terms without our consent; we may assign them without restriction.
